Is the Anti-Corruption Service a law enforcement agency?

Yes it is. In accordance with Article 3 of the Law of the Republic of Kazakhstan "On Law Enforcement Service", law enforcement agencies include the prosecutor's office, internal affairs, anti-corruption service and the Economic Investigation Service, which carry out their activities in accordance with the legislative acts of the Republic of Kazakhstan.


Do the citizens pass a test who enter the  Anti-Corruption Body for the first time?

The citizens first entering the service in law enforcement bodies, with the exception of those who come to study in the law enforcement bodies, are tested, including the assessment of personal qualities in the authorized body for civil service (article 7, paragraph 1 of the Law of the Republic of Kazakhstan "On law enforcement service ").


How are the qualification classes of the employees of the anti-corruption service divided?

In accordance with Article 22-1 of the Law of the Republic of Kazakhstan "On Law Enforcement Service" for employees of the anti-corruption service there exist the following qualification categories and terms of the offices: 1) middle ranking officers: qualification grade of  the 6th category - one year; qualification grade of the 5th category - three years; qualification grade of the  4th  category - four years;

2) senior commanding staff: qualification grade of the 3rd category - five years; qualification grade of the 2nd category - seven years; qualification grade of the 1st category - the terms of it  is not established.

In addition, depending on the sequence of establishment, the qualification grades are divided into the first and the next. The first qualification grade  is the qualification grade of the 6th category.


The next qualifying classes are established in a sequential order after the expiry of the term in the previous qualification grades. What is included in the concept of "conflict of interest"?

A conflict of interests should be understood as a contradiction between the personal interests of persons holding a responsible public office, persons authorized to perform public functions, persons equated to them, officials and their official powers, in which the personal interests of these persons may lead to improper performance of their official powers (Article 1 paragraph 5) of the Law of RK «On  anti-corruption »).


Are there any encouragement  for those who reported corruption facts?

For persons who reported a fact of corruption offense or otherwise assisting in countering corruption, encouragement is established as  one-time monetary reward.  One-time monetary reward is established in the following amounts: 1) there have been established 30 monthly calculation indicators for administrative cases of corruption (hereinafter - MCI); 2) 40 MCI - on criminal cases on corruption minor crimes; 3) 50 MCI - on criminal cases on corruption ordinary crimes; 4) 70 MCI - on criminal  serious corruption crimes; 5) on criminal cases on especially grave corruption crimes - 100 MCI. In addition, encouragement can be established in the form of rewarding with a certificate or a commendation (Decree of the Government of the Republic of Kazakhstan of December 30, 2015, No. 1131 "On approval of the Rules for the Encouragement of Persons Who Reported a Corruption Offense or otherwise Assisting in Countering Corruption").
